An industry-wide report by OFGEM has identified the practices of the Energy Providers using third- party energy brokers who have been paid secret commissions hidden in energy contracts.

OFGEM investigated the issues faced by business customers in regard to the UK energy market. This 2019 review found that businesses invariably rely on broker intermediaries to switch utility contracts,with weak regulation allowing room for sharp practices by those brokers.

These sharp practices were distilled by OFGEM into 8 ‘Theories of Harm’; chief among them was lack of transparency of broker costs and commission.

OFGEM describe this lack of transparency by stating ‘The supplier/third party intermediary (broker) contracting process is overly complex, costly and opaque, leading to some business customers ending up with costly contracts on disadvantageous terms’.

  • The profi t margin an energy provider is allowed to make in the domestic sector is capped at 1.9% by the regulator OFGEM. Non domestic (the business sector) margin is uncapped meaning profit margins can soar in a largely unregulated market; estimated at 30%+. Source: OFGEM
  • OFGEM, the UK energy regulator, operates tight controls on the domestic energy sector through a high regulatory regime deployed through programmes such as the ‘code of practice for online domestic price comparison services’. No such regulation exists for the UK business sector, even now, with just some low-level licence changes introduced in 2022. Energy brokers remain free of regulation.
